1. Agreement to Terms

By accessing or using AEAX's services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Services.

These Terms constitute a legally binding agreement between you and AEAX. Please read them carefully before using our Services.

2. Description of Services

AEAX provides open banking and financial management services that allow you to:

  • Connect and aggregate financial accounts from multiple institutions
  • View consolidated account balances and transaction history
  • Receive AI-powered financial insights and recommendations
  • Track spending patterns and manage budgets
  • Set and monitor financial goals

Limitation: AEAX provides read-only access to your financial data. We do not have the ability to move funds, execute transactions, or make changes to your accounts.

3. Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Be a legal resident of a jurisdiction where our Services are available
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Services under applicable law

4. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your login credentials confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

5. Open Banking Authorization

By connecting your financial accounts, you:

  • Authorize AEAX to access your financial data through secure open banking protocols
  • Confirm that you are the authorized account holder or have permission to access the accounts
  • Understand that we use licensed third-party data aggregators to facilitate connections
  • Acknowledge that your financial institution's terms of service also apply

6. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Services or servers
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Use automated means to access the Services without permission
  • Transmit malware, viruses, or other harmful code
  • Impersonate any person or entity
  • Use the Services to commit fraud or money laundering

7. Intellectual Property

The Services, including all content, features, and functionality, are owned by AEAX and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without explicit permission.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not warrant that:

  • The Services will be uninterrupted, timely, secure, or error-free
  • Financial data will be accurate, complete, or current at all times
  • Any insights or recommendations will be suitable for your specific situation
  • Connections to financial institutions will always be available

AEAX does not provide financial advice. Our insights are for informational purposes only. You should consult with qualified financial professionals before making financial decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AEAX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Service interruptions
  • Unauthorized access to your data
  • Errors or inaccuracies in financial data
  • Decisions made based on our insights or recommendations

Our total liability shall not exceed the amount you paid for the Services in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless AEAX and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Services, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the Services will cease immediately
  • We may delete your account and associated data
  • Provisions that by their nature should survive will remain in effect

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AEAX regarding the Services and supersede all prior agreements.
